Before applying to Court for an uncontested divorce, please speak with a lawyer first, to ensure that applying for divorce is the correct step. A lawyer will ask a few questions to determine whether or not an application for divorce would likely be opposed (contested) and whether or not this is a situation in which a divorce Order could be granted.
For example, if custody, child or spousal support, division of assets, or other issues arising from your separation are unresolved, an application for divorce could land you in a messy and costly court proceeding. It’s far preferable to resolve those issues out of court first (this is work The New Family Law Center can help you with), and then proceed with an uncontested application for divorce after a separation agreement has been signed.
There are several other areas of difficulty when processing a divorce, and hiring a family law lawyer to handle the matter will help ensure the divorce Order is granted and the best process is followed. I suggest you ensure that the lawyer is preparing your documents, rather than a secretary, clerk, or paralegal. For an uncontested divorce, you should expect to pay a flat rate inclusive of all fees, disbursements, and taxes (rather than pay an hourly rate).
